The Sixth Administrative Court of Appeal in Kiev overturned the decision of the District Administrative Court to recognize as illegal the conclusion of the Institute of National Remembrance that the symbols of the SS «Galicia» are not Nazi, and therefore do not fall under the ban of the symbols of the communist and national socialist regimes.

This was reported by the lawyer Lyudmila Braslavskaya, Ukrainian News reports.

“Unfortunately, the decision is negative for us,” she said.

As noted in court, she represented the interests of Natalya Myasnikova, who asked the court to declare illegal the response of the then head of the Institute of National Remembrance Vladimir Vyatrovich to the Strana’s request in 2017.

In her claim, the applicant noted that the SS Galicia Division was part of the Waffen-SS troops, which the Nuremberg Tribunal declared a criminal organization in 1946.

In her opinion, the former head of the Institute of National Memory distorted historical facts and exceeded his authority.

Braslavskaya said that today the court considered the appeal of the Institute of National Memory and satisfied it, thereby canceling the decision of the lower court, which recognized the symbols of the SS Galicia division as Nazi.

The lawyer also stated that such a court decision was a surprise to her and she was at a loss. She emphasized that she will lodge a cassation appeal with the Supreme Court against the decision of the Court of Appeal.

Recall that in May, the Kiev District Administrative Court declared illegal the conclusion of the Institute of National Remembrance that the symbols of the SS Galicia division were not Nazi and, accordingly, did not fall under the legislation banning the symbols of communist and national socialist regimes. At the same time, the court satisfied the claim of natural person Natalya Myasnikova only partially and dismissed other parts of her claim. In particular, he did not prohibit the «propaganda of the symbols of the SS» Galicia «.
